Affiliate Program Terms and Conditions

1. Program Overview

The Real World IQ™ Affiliate Program ("Program") is operated by Advanced Learning Academy ("Company," "we," "us," or "our"). By participating in this Program, you ("Affiliate," "you," or "your") agree to be bound by these Terms and Conditions.

2. Commission Structure

Cognitive Assessments (RWIQ, Bio Age, RELIQ)

• Standard Test ($99): a flat 50% of the first payment ($49.50 commission per sale)
• Premium / Couples / Tracker ($149 - $199): a flat 50% of the first payment ($74.50 - $99.50 commission per sale)
• Retest ($49): No commission (retests are excluded from affiliate program)

Life Intelligence Suite

• Standard ($249): a flat 50% of the first payment ($124.50 commission per sale)
• Premium ($299): a flat 50% of the first payment ($149.50 commission per sale)

SumCruncher Brain Training

• Annual Subscription ($39.95/year): a flat 50% of the first payment ($19.98 commission per annual subscription)
• Monthly Subscription ($4.99/month): No commission
• Assessment Sales via Test Ads: 50% of the first sale amount — free SumCruncher players see 15-second assessment ads; any resulting purchase earns you 50% of that first sale

Commissions are tracked via a 90-day cookie and server-side verification. Last-click attribution model applies.

3. Payment Terms

• Payouts are processed bi-weekly (1st and 15th of each month)
• Minimum payout threshold: one approved sale
• Payment methods: PayPal or Zelle only. We never collect banking information.
• Commissions are paid only for completed, non-refunded purchases
• Commissions remain in "pending" status for 7 days to account for potential refunds (industry standard is 30 days)
• You are responsible for all applicable taxes on your commission earnings
• Refund deductions: If a referred customer receives a refund, the corresponding commission is deducted from your pending or future balance.

4. Tracking & Attribution

• We use encrypted cookies along with server-side verification to track referrals
• Your unique referral link format: advancedlearning.academy/?ref=YOURCODE
• Real-time dashboard access to track clicks, conversions, and earnings
• We are not responsible for tracking failures due to user browser settings, ad blockers, or VPNs

7. Representations & Warranties

By participating in this Program, you represent and warrant that:

• You are at least 18 years of age
• You have the legal authority to enter into this agreement
• All information provided during registration is accurate and complete
• You will comply with all applicable laws and regulations, including FTC disclosure requirements
• You will clearly disclose your affiliate relationship in all promotional content

8. FTC Disclosure Requirements

You must clearly and conspicuously disclose your affiliate relationship in all promotional content. Examples of compliant disclosures:

• "This post contains affiliate links. I may earn a commission if you purchase."
• "#ad #affiliate #sponsored"
• "Disclosure: I'm a paid affiliate for Real World IQ."

Failure to disclose may result in account termination and potential legal liability.

9. Intellectual Property

• We grant you a limited, non-exclusive license to use our approved marketing materials
• You may not modify our logos, trademarks, or copyrighted content without written permission
• All intellectual property rights remain with Advanced Learning Academy
• This license terminates immediately upon termination of your affiliate account

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the commissions actually paid to you in the prior 12 months
• We make no guarantees regarding earnings, conversion rates, or program continuity
• You agree to indemnify and hold us harmless from claims arising from your promotional activities

11. Termination

Either party may terminate this agreement at any time:

• By You: Email us at [email protected] to close your account
• By Us: We may terminate immediately for cause, or with 30 days notice without cause
• Upon termination, all pending commissions for verified, non-fraudulent sales will be paid within 60 days
• Commissions earned through prohibited activities will be forfeited

12. Modifications

We may modify these terms at any time. Material changes will be communicated via email to your registered address. Continued participation after notice constitutes acceptance of modified terms.

13. Governing Law & Disputes

This agreement is governed by the laws of the State of Indiana, USA. Any disputes shall be resolved through binding arbitration in Indianapolis, Indiana, in accordance with AAA rules. You waive any right to participate in class action lawsuits.

14. Severability

If any provision of these terms is found unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms and Conditions constitute the entire agreement between you and Advanced Learning Academy regarding the affiliate program and supersede all prior agreements.
